## The 57th GST Council: Arrest Powers Gone, Prosecution Threshold at ₹5 Crore, and No Rate Change

The **57th GST Council met at Bharat Mandapam, New Delhi on Thursday, October 8**, chaired by Finance & Corporate Affairs Minister **Nirmala Sitharaman**, with the Chief Ministers of Delhi, Goa, Haryana, Jammu & Kashmir, Karnataka, Kerala, Maharashtra and Meghalaya, the Deputy Chief Ministers of Manipur and Telangana, and state finance ministers participating. It was the **first Council meeting since the 56th in September 2025** that delivered the two-rate structure.

**The headline is what the Council did not do: it left GST rates untouched.** Sitharaman said the next-generation reforms have addressed **about 99% of issues related to tax rates and processes**, confirmed that **rate questions will now be taken up only once a year at a dedicated session**, and signalled a push towards **faceless tax administration**.

**What the Council recommended:**

- **Removal of arrest powers under section 69 of the CGST Act.**
- **Prosecution threshold raised from ₹1 crore to ₹5 crore.**
- **Maximum general penalty under section 125 cut from ₹25,000 to ₹10,000**, and a **₹10,000 minimum threshold for tax demand notices**.
- **Faster, system-based automated processing of refunds**, with automated processing of specified registration cancellations.
- **Wider ITC and refund eligibility**, including **refund of accumulated ITC on capital goods and input services**, amendments to **section 17(5) to remove certain blocked-credit restrictions**, and an alternate return mechanism for **amending liabilities and ITC to cut mismatch notices**.
- **Rule 86A amended** to give the taxpayer an **opportunity of being heard**; **intelligence-based and authorised interception** of goods in transit; **e-way bill rationalisation**.
- **Late-fee waiver** on delayed section 39(1) returns for taxpayers with turnover **up to ₹5 crore**, if filed by the end of the due month.
- An **in-principle optional Annual Return Quarterly Payment (ARQP) scheme** for small consumer-facing businesses with turnover **up to ₹5 crore**.
- **Clarifications on EVs** (passenger transport and rental of motor vehicles using EVs), **transportation and delivery services through e-commerce operators**, motor-vehicle leasing, helicopter passenger transport, **transfer of title in intellectual property rights**, and payments to **NHAI under the Toll-Operate-Transfer model**.
- **Implementation dates of November 2026 and April 2027** attach to certain proposals.

**These are recommendations, not self-executing law** — legal effect depends on subsequent legislation and notifications. Separately, the Council's outcomes note records the **effective domestic tax rate has fallen from 14.55% to 13.13%**, a drop of about 1.5 percentage points, with **GST revenue up 11% in FY 2026-27** and **14.7% growth over June-August 2026**.

**Inference disclosure (Rule 6):** **PIB names no company.** The mappings below are my inferences from the categories the Council covered, not disclosed beneficiaries.

| Stock | Impact | Reason | Confidence |
|---|---|---|---|
| SUNPHARMA, DRREDDY, CIPLA | 🟢 Positive | ⚠️ inferred. Automated refunds, wider ITC on input services and capital goods, and a ₹10,000 floor on demand notices directly cut working capital locked in the tax system for large manufacturers | 3/5 |
| TCS, INFY, HCLTECH | 🟢 Positive | ⚠️ inferred. Return reconciliation, clarifications on **export of services** and on work done in India on a foreign client's goods treated as an export reduce compliance friction for the services exporters | 3/5 |
| WELSPUNLIV, TRIDENT, KPRMILL | 🟢 Positive | ⚠️ inferred. E-way bill rationalisation and smoother inter-state movement of goods are the largest operational gain for multi-plant textile manufacturers | 2/5 |
| PAYTM | 🟢 Positive | ⚠️ inferred. Simplified GST registration for **small sellers on e-commerce operator platforms** is a direct onboarding-volume tailwind for payment and seller platforms | 2/5 |
| BAJFINANCE, HDFCBANK, ICICIBANK | 🟢 Positive | ⚠️ inferred. Removing blocked-credit restrictions and protecting genuine buyers from supplier-default ITC loss reduces the credit risk sitting inside lender and lessor books | 2/5 |
| ULTRACEMCO, APLAPOLLO, JINDALSAW | 🟢 Positive | ⚠️ inferred. Refund of tax on **plant and machinery over five years** and the NHAI TOT clarifications affect capital-goods-heavy and project-linked manufacturers | 2/5 |

## The Market: Nifty's Lowest Close Since April 2025, ₹11.56 Lakh Crore of Wealth Gone in One Session

**Sensex 71,593.24, down 1,045.46 points or 1.44%** (intraday low 71,327.75, a fall of 1,310.95 points). **Nifty 50 22,231.80, down 371.25 points or 1.64%**, with an intraday low of **22,179.90 — the 2026 low — and the lowest closing level since April 2025**.

- **Total market capitalisation fell from ₹4,72,35,273.39 crore to ₹4,60,78,788.55 crore — an erosion of roughly ₹11.56 lakh crore**, or about **2.45%**.
- **All 11 major NSE sectoral indices closed lower.** **Nifty Metal fell 3.55%**, its **steepest single-day decline since March 23, 2026**, with **every constituent lower**; **Realty and Oil & Gas** were the next worst.
- **Nifty Midcap 100 fell 2.53% and Nifty Smallcap 100 fell 2.34%.** Of **3,722 stocks traded, only 660 advanced against 2,950 declines** — an advance-decline ratio of about **0.22**. **271 stocks hit fresh 52-week lows against 71 new highs.**
- **India VIX jumped more than 10% to above 15.** **Bank Nifty fell 0.98%**, relatively resilient.
- **Foreign investors sold ₹6,121 crore of Indian equities on Wednesday — a ninth consecutive session of selling** — with provisional Thursday cash outflows reported at **₹-12,944 crore**.
- The **rupee fell 13 paise to close at 96.88 against the US dollar**, close to the all-time low of **96.96** set in May 2026 and **more than 7% weaker this year**.
- Triggers: Wednesday's **RBI repo hike to 5.50%** and the switch to a **"calibrated tightening"** stance, **Brent crude up 4.25% to USD 104.5**, and rising US Treasury yields.

| Stock | Impact | Reason | Confidence |
|---|---|---|---|
| JSWSTEEL, ADANIENT | 🔴 Negative | The two worst Nifty constituents, down 4.46% and 5.36%; the 3.55% fall in Nifty Metal with every constituent lower is the cleanest read of the rate-and-crude shock | 4/5 |
| ITC, HINDUNILVR, TITAN | 🔴 Negative | FMCG and consumer discretionary were sold hard — ITC -4.03% — on a weaker rupee, elevated crude and the tightening stance | 3/5 |
| INDIGO, MAXHEALTH, ADANIPORTS, NTPC, RELIANCE, MARUTI, BEL | 🔴 Negative | Broad-based risk-off across fuel-cost, capex and defence-capex names; IndiGo -3.55% and BEL -2.96% | 3/5 |
| INFY, TECHM, AXISBANK | 🟢 Positive | The only three Sensex gainers; IT services and one large private bank absorbed the flow when almost everything else was hit | 3/5 |

## The Reported UPI MDR Deferral Took 5% off Paytm and 4% off the Payments Complex

Reports on **October 8** said the government may **defer the merchant discount rate on UPI from the scheduled October 15 rollout to January 1, 2027**, after **NPCI received requests from merchant bodies and fintechs** citing confusion over applicable rates, transaction categories and the treatment of different payment types. **The deferment is not final — a decision is expected in the coming days.**

- The charge as designed: **0.4% on person-to-merchant UPI above ₹2,000**, capped at **₹300 for transactions of ₹75,000 and above**, a **flat ₹5 for railways, telecom, insurance and fuel**, and **person-to-person UPI free at all values**.
- **Paytm fell as much as about 8% intraday and closed 5.2% lower; One MobiKwik fell 4.5%; Pine Labs fell 4.4%.**

| Stock | Impact | Reason | Confidence |
|---|---|---|---|
| PAYTM, MOBIKWIK, PINELABS | 🔴 Negative | ⚠️ inferred. The MDR is the monetisation mechanism these platforms have been positioned around; a slip to January defers the revenue line and reintroduces policy uncertainty | 4/5 |
| HDFCBANK, ICICIBANK, AXISBANK, SBIN | 🟡 Watch | ⚠️ inferred. Acquiring banks earn the merchant fee on qualifying transactions; the delay trims a nascent revenue line but the base business is unaffected | 2/5 |
| WELSPUNLIV, TRIDENT, TITAN, ULTRACEMCO | 🟢 Positive | ⚠️ inferred. Merchants bear the 0.4%; a delay keeps the current cost structure in place through the festive quarter for high-ticket retailers | 2/5 |

## TCS Opened Q2 FY27: PAT Up 15% to ₹13,884 Crore, AI Revenue Past USD 3.1 Billion, ₹12 Dividend

- **Annualised AI revenue crossed USD 3.1 billion — over 10% of total revenue.**

- Named wins included **strategic partnerships with Porsche (including the acquisition of MHP) and Best Buy's GCC transition to AI**.

| Stock | Impact | Reason | Confidence |
|---|---|---|---|
| TCS | 🟢 Positive | Beats on both profit and the poll on revenue, with AI revenue annualising above USD 3.1 billion; the ₹12 dividend is the second of the year | 4/5 |
| INFY, HCLTECH, WIPRO, TECHM | 🟡 Watch | The read-through is constructive on AI monetisation and BFSI recovery, but margin commentary from Infosys (October 23) and HCL Tech (October 12) will set the sector trend | 3/5 |

## Primary Market: Two Mainboard Listings Today, Eight September Issues Listing Through October

- **Nityas Gems & Jewellery and Vishal Nirmiti listed on October 8.**
- **Eight mainboard IPOs that opened in the last week of September list through October**, including **Moneyview, A-One Steels India, Acevector (Snapdeal), Orient Cables and German Green Steel**.

| Stock | Impact | Reason | Confidence |
|---|---|---|---|
| BSE, ANGELONE, MOTILALOFS | 🟢 Positive | ⚠️ inferred. Listing fee and brokerage revenue scale with both issue count and the secondary-market activity that follows | 3/5 |
| CAMS, KFINTECH | 🟢 Positive | ⚠️ inferred. Registrar and transfer-agent volumes track the primary-market pipeline | 2/5 |

|---|---|---|---|
| BSOFT | 🟢 Positive | A named place inside OpenAI's partner network is a direct route into generative-AI deployment spend for a mid-cap services firm | 3/5 |
| NAUKRI | 🟡 Watch | Billing growth of 12.8% with a 27.2% decline in Shiksha shows a two-speed portfolio; the stock's 3% fall says the market wanted more | 3/5 |
| ICICIGI, GICRE | 🟡 Watch | H1 FY27 non-life premium growth of 8.92% is intact, but the sharp fall in agriculture insurance narrows the growth mix | 2/5 |
| MOTILALOFS | 🟢 Positive | A 20.4% IRR and full exit of all 37 positions in the 2020-vintage ₹1,155 crore fund is a clean realised track record | 2/5 |
