The 57th GST Council: Arrest Powers Gone, Prosecution Threshold at ₹5 Crore, and No Rate Change

The 57th GST Council met at Bharat Mandapam, New Delhi on Thursday, October 8, chaired by Finance & Corporate Affairs Minister Nirmala Sitharaman, with the Chief Ministers of Delhi, Goa, Haryana, Jammu & Kashmir, Karnataka, Kerala, Maharashtra and Meghalaya, the Deputy Chief Ministers of Manipur and Telangana, and state finance ministers participating. It was the first Council meeting since the 56th in September 2025 that delivered the two-rate structure.

The headline is what the Council did not do: it left GST rates untouched. Sitharaman said the next-generation reforms have addressed about 99% of issues related to tax rates and processes, confirmed that rate questions will now be taken up only once a year at a dedicated session, and signalled a push towards faceless tax administration.

What the Council recommended:

  • Removal of arrest powers under section 69 of the CGST Act.
  • Prosecution threshold raised from ₹1 crore to ₹5 crore.
  • Maximum general penalty under section 125 cut from ₹25,000 to ₹10,000, and a ₹10,000 minimum threshold for tax demand notices.
  • Faster, system-based automated processing of refunds, with automated processing of specified registration cancellations.
  • Wider ITC and refund eligibility, including refund of accumulated ITC on capital goods and input services, amendments to section 17(5) to remove certain blocked-credit restrictions, and an alternate return mechanism for amending liabilities and ITC to cut mismatch notices.
  • Rule 86A amended to give the taxpayer an opportunity of being heard; intelligence-based and authorised interception of goods in transit; e-way bill rationalisation.
  • Late-fee waiver on delayed section 39(1) returns for taxpayers with turnover up to ₹5 crore, if filed by the end of the due month.
  • An in-principle optional Annual Return Quarterly Payment (ARQP) scheme for small consumer-facing businesses with turnover up to ₹5 crore.
  • Clarifications on EVs (passenger transport and rental of motor vehicles using EVs), transportation and delivery services through e-commerce operators, motor-vehicle leasing, helicopter passenger transport, transfer of title in intellectual property rights, and payments to NHAI under the Toll-Operate-Transfer model.
  • Implementation dates of November 2026 and April 2027 attach to certain proposals.

These are recommendations, not self-executing law — legal effect depends on subsequent legislation and notifications. Separately, the Council's outcomes note records the effective domestic tax rate has fallen from 14.55% to 13.13%, a drop of about 1.5 percentage points, with GST revenue up 11% in FY 2026-27 and 14.7% growth over June-August 2026.

The Reported UPI MDR Deferral Took 5% off Paytm and 4% off the Payments Complex

Reports on October 8 said the government may defer the merchant discount rate on UPI from the scheduled October 15 rollout to January 1, 2027, after NPCI received requests from merchant bodies and fintechs citing confusion over applicable rates, transaction categories and the treatment of different payment types. The deferment is not final — a decision is expected in the coming days.

  • The charge as designed: 0.4% on person-to-merchant UPI above ₹2,000, capped at ₹300 for transactions of ₹75,000 and above, a flat ₹5 for railways, telecom, insurance and fuel, and person-to-person UPI free at all values.
  • Paytm fell as much as about 8% intraday and closed 5.2% lower; One MobiKwik fell 4.5%; Pine Labs fell 4.4%.

PAYTM, MOBIKWIK, PINELABS🔴 Negative⚠️ inferred. The MDR is the monetisation mechanism these platforms have been positioned around; a slip to January defers the revenue line and reintroduces policy uncertainty4/5
HDFCBANK, ICICIBANK, AXISBANK, SBIN🟡 Watch⚠️ inferred. Acquiring banks earn the merchant fee on qualifying transactions; the delay trims a nascent revenue line but the base business is unaffected2/5
WELSPUNLIV, TRIDENT, TITAN, ULTRACEMCO🟢 Positive⚠️ inferred. Merchants bear the 0.4%; a delay keeps the current cost structure in place through the festive quarter for high-ticket retailers2/5
